In one recent case, 70 companies operating Serviced Apartments reinstated two of its long-term domestic employees as independent contractors to provide identical household services, but through a form of three-part contracts called the Odco Agreement.71 In the management of Odco contracts, workers were first linked as independent contractors to a third-party contractor. which, in turn, provided the services provided by the workers under an employment contract to the host organizer. As a general rule, the duties and responsibilities of an independent contractor should not include the essential functions of the business. For example, a painter commissioned by a software company to paint a building outside will be considered an independent contractor rather than a painter hired by a paint company who receives paint and painting tools from the rental company to paint a residence. It is more difficult to distinguish a computer programmer working in the IT department from a large company. In cases where the distinction may be blurred, it is particularly important to define the role as time and scale limit and to highlight other elements of the relationship that suggest independent contracting status, such as. B unique skills or skills. At trial, the Federal Court of Justice recognized the legality of the Odco agreement and therefore decided that the owners were legitimate contractors. On appeal, the Federal Court of Australia examined the substance of the Hou-sekeepers` labour relations by applying the multifactorial totality test and found that it was unlikely that any sensible person would accept that he or she would work in the cases.72 Many states apply another test to the ABC test, particularly with respect to unemployment.
